Please ensure that you read, understand and accept Marbella Rent a Bike’s Terms and Conditions of Rental as no exception will be made to these.

1. Marbella Rent a Bike rents bikes only with prior booking. Bike rentals are daily and not 24h. the Rental day period starts at 9:30 h and ends at 18:30 h. 

2. The rented equipment can be delivered and collected to/from the customer’s hotel or accommodation or any other place previously appointed. Delivery and pick up will carry a charge pre‐set by Marbella Rent a Bike. Rented bicycles can also be picked up and returned to Marbella Rent a Bike’s premises in Nueva Andalucia, Marbella by clients as long as the client can provide a secure transport method.

3. The bicycles will be delivered and picked up on the day and time according to the booking or rental agreement. Customer delays, both on delivery and pick up of bikes, without notifying Marbella Rent a Bike, will result in an additional charge of 15€ if delivery & pick up service must be re‐programmed plus the corresponding delivery and pick up charge.

4. At the end of the rental period the customer must return the bicycles to a Marbella Rent a Bike representative.

5. The client acknowledges that Marbella Rent a Bike will do its best to deliver and pick up from locations at agreed upon times, but force majeure or other exceptional circumstances (unusual traffic en route to drop‐off or delivery) may cause delays. The client agrees to adhere to delivery and pick‐up times themselves and authorize Marbella Rent a Bike to charge their credit card if meeting times are not met and additional expenses are incurred due to renter lateness (i.e. staff time, highway tolls etc). If there are changes to the pick‐up location or time once the rental has started this must be communicated by confirmed email or direct telephone contact at least 24 hours before the bicycles are due to return to Marbella Rent a Bike

RESERVATION, PAYMENT, DEPOSIT AND CANCELATION

6. Bike reservations must be done with enough anticipation in order for Marbella Rent a Bike to confirm availability, however if the customer needs a bike on the same day he/she may call (+34 628 174 930) to check for availability. Advance reservations of bicycles can be made online on our website.

7. Method of payment: Credit/Debit card ‐ Payment for the rented items is required to be made in full prior to delivery. The reservation is only confirmed once Marbella Rent a Bike has confirmed receipt of the payment via E‐mail.

8. The customer will be asked for his/her passport details along with credit card details as a guarantee deposit for the rented equipment. At the end of the rental period, the customer accepts the charges for any damages caused and/or missing or broken items, at market prices which will be charged to their credit card. The deposit will be refunded in full if the rented equipment is returned in the same condition it was procured. If the missing or broken items exceed the deposit amount, the customer must settle the balance.

9. Cancelations with refund are only admitted 15 working days before the programmed delivery date. These cancelleations will inccur a 10% administration and handling fee plus a 3,5% credit card fee. Cancellations made within 15 working days of the delivery date are charged in full. Reservation no shows are charged in full, and considered non‐refundable. Exceptions to this policy cannot be made for any reason.

10. No refund or credit will be made, for any given reason, for cancelations within 15 working days from the start date of the rental; early return of the bicycles or for cancelations of guided training rides. The client understands and accepts that Marbella Rent a Bike is not responsible for the client’s personal circumstances, sicknesses, weather conditions or any event outside of Marbella Rent a Bike’s direct control nor force majeure and can therefore not accept refund or credit requests made by the client for any of the above reasons. Exceptions to this policy cannot be made for any reason.

RENTAL EQUIPMENT – Please treat our bikes as you would your own!

11. Marbella Rent a Bike confirms that all its bicycles are presented to customers in an immaculate working order, set up by professional mechanics and whilst Marbella Rent a Bike accept general wear and tear during hire, any rental equipment returned with excessive cleaning needs, where the bike will need to be taken apart, will incur a 50€ charge per bike to the client.

12. The rented bicycles and equipment may only be used by the designated customer and the members of his/her party as mentioned in the Rental Contract.

13. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss or theft. In case of damage, loss or theft of the bicycle/s, components or any of its parts, Marbella Rent a Bike will charge the customer the full cost of the damages caused or missing items at market prices.

14. In case of emergency, Marbella Rent a Bike can assist clients in recovery of their person and/or the rental equipment. This service will incur a charge of 2€ per total kilometres during weekdays and 3€ per total kilometres during weekends and bank holidays. The total kilometres are calculated based on the starting and end point being the Marbella Rent a Bike shop.

15. Bikes for Urban use are rented with a high security lock and the customer is obliged to lock the bicycle/s properly at all times when unattended, passing the lock through the frame and attaching the bike(s) to something fixed to the ground like a post or fence, if allowed, or else, a bicycle parking. It is highly recommended to keep the bikes secured at all times especially during over‐night rentals. Racing and mountain bikes will not be provided with locks as the customer is NOT to leave the bikes unattended under any circumstances.

LIMITATION OF LIABILITY

16. Marbella Rent a Bike has procured itself with proper third party liability insurance coverage of the bicycle rental activity. Marbella Rent a Bike is not responsible for injury or damages caused to/by the client during the hire period.

17. The customer is responsible for adequate personal insurance coverage for risks that may occur during the rental period. Marbella Rent a Bike is not liable for any claims for body injury or harm, accidents or loss of personal belonging caused by weather, sickness, or any other causes whatsoever beyond the control of Marbella Rent a Bike.

18. The customer and his/her group must respect Spanish traffic regulations. Any ticket or fine due to incorrect use of the bicycle will be completely assumed by the customer.

19. The information the customer provides is protected by organic law 15/1999 of 13th December regarding the protection of personal data.

20. Exclusive place of jurisdiction shall be Marbella, Spain. This contract shall be governed by Spanish law.

Términos y condiciones de alquiler (Español) 

Por favor, asegúrese de leer, comprender y aceptar los Términos y Condiciones de Alquiler de Marbella Rent a Bike, ya que no se harán excepciones a estos términos.

1. Marbella Rent a Bike alquila bicicletas solo con reserva previa. Los alquileres de bicicletas son diarios y no de 24 horas. El período de alquiler comienza a las 9:30 h y termina a las 18:30 h.

2. El equipo alquilado puede ser entregado y recogido en el hotel, alojamiento u otro lugar designado por el cliente. La entrega y recogida tendrán un cargo preestablecido por Marbella Rent a Bike. Las bicicletas alquiladas también pueden ser recogidas y devueltas a las instalaciones de Marbella Rent a Bike en Nueva Andalucía, Marbella, por los clientes, siempre y cuando el cliente pueda proporcionar un método de transporte seguro.

3. Las bicicletas serán entregadas y recogidas en el día y hora acordados según la reserva o contrato de alquiler. Los retrasos por parte del cliente, tanto en la entrega como en la recogida de las bicicletas, sin notificar a Marbella Rent a Bike, resultarán en un cargo adicional de 15 € si el servicio de entrega y recogida debe ser reprogramado, más el correspondiente cargo por entrega y recogida.

4. Al final del período de alquiler, el cliente debe devolver las bicicletas a un representante de Marbella Rent a Bike.

5. El cliente reconoce que Marbella Rent a Bike hará todo lo posible para entregar y recoger en los lugares y horarios acordados, pero la fuerza mayor u otras circunstancias excepcionales (tráfico inusual en el camino hacia la entrega o recogida) pueden causar retrasos. El cliente acepta cumplir con los horarios de entrega y recogida y autoriza a Marbella Rent a Bike a cargar su tarjeta de crédito si no se cumplen los horarios y se incurre en gastos adicionales debido a la tardanza del arrendatario (por ejemplo, tiempo del personal, peajes de autopista, etc.). Si hay cambios en el lugar o el horario de recogida una vez que ha comenzado el alquiler, esto debe comunicarse por correo electrónico confirmado o contacto telefónico directo al menos 24 horas antes de que las bicicletas deban regresar a Marbella Rent a Bike.

RESERVA, PAGO, DEPÓSITO Y CANCELACIÓN

6. Las reservas de bicicletas deben hacerse con suficiente antelación para que Marbella Rent a Bike pueda confirmar la disponibilidad. Sin embargo, si el cliente necesita una bicicleta el mismo día, puede llamar al (+34 628 174 930) para verificar la disponibilidad. Las reservas anticipadas de bicicletas se pueden hacer en línea o enviando un correo electrónico a info@marbellarentabike.com.

7. Método de pago: Tarjeta de crédito/débito - Se requiere el pago completo de los artículos alquilados antes de la entrega. La reserva solo se confirma una vez que Marbella Rent a Bike ha confirmado la recepción del pago por correo electrónico.

8. Se solicitarán los datos del pasaporte del cliente junto con los detalles de la tarjeta de crédito como depósito de garantía para el equipo alquilado. Al final del período de alquiler, el cliente acepta los cargos por los daños causados y/o los elementos faltantes o rotos, a precios de mercado que se cargarán en su tarjeta de crédito. El depósito se reembolsará en su totalidad si el equipo alquilado se devuelve en las mismas condiciones en que se adquirió. Si los elementos faltantes o rotos superan el monto del depósito, el cliente debe saldar el saldo.

9. Solo se admiten cancelaciones 15 días hábiles antes de la fecha de entrega programada. Estas cancelaciones incurrirán una tarifa de administracion del 10% de importe del alquiler mas 3,5% tarifa de tarjeta de credito. Las cancelaciones realizadas dentro de los 15 días hábiles previos a la fecha de entrega se cobran en su totalidad. Las reservas que no se presenten se cobran en su totalidad y se consideran no reembolsables. No se pueden hacer excepciones a esta política por ningún motivo.

10. No se realizarán reembolsos ni créditos, por ningún motivo, por cancelaciones dentro de los 15 días hábiles desde la fecha de inicio del alquiler; devolución anticipada de las bicicletas o cancelaciones de paseos de entrenamiento guiados. El cliente entiende y acepta que Marbella Rent a Bike no es responsable de las circunstancias personales del cliente, enfermedades, condiciones climáticas o cualquier evento fuera del control directo de Marbella Rent a Bike, ni de la fuerza mayor, y por lo tanto no puede aceptar solicitudes de reembolso o crédito del cliente por ninguno de los motivos anteriores. No se pueden hacer excepciones a esta política por ningún motivo.

EQUIPO DE ALQUILER - ¡Trate nuestras bicicletas como si fueran suyas!

11. Marbella Rent a Bike confirma que todas sus bicicletas se presentan a los clientes en perfecto estado de funcionamiento, configuradas por mecánicos profesionales y aunque Marbella Rent a Bike acepta el desgaste normal durante el alquiler, cualquier equipo de alquiler devuelto con necesidades de limpieza excesiva, donde sea necesario desmontar la bicicleta, incurrirá en un cargo de 50 € por bicicleta al cliente.

12. Las bicicletas y el equipo alquilados solo pueden ser utilizados por el cliente designado y los miembros de su grupo mencionados en el Contrato de Alquiler.

13. El cliente está obligado a cuidar bien del equipo alquilado y protegerlo de daños, pérdida o robo. En caso de daño, pérdida o robo de la(s) bicicleta(s), componentes o cualquier parte de las mismas, Marbella Rent a Bike cargará al cliente el costo total de los daños causados o los elementos faltantes a precios de mercado.

14. En caso de emergencia, Marbella Rent a Bike puede ayudar a los clientes a recuperar su persona y/o el equipo de alquiler. Este servicio tendrá un cargo de 2 € por kilómetro total durante los días laborables y 3 € por kilómetro total durante los fines de semana y días festivos. Los kilómetros totales se calculan en función del punto de partida y de llegada en la tienda de Marbella Rent a Bike.

15. Las bicicletas para uso urbano se alquilan con un candado de alta seguridad y el cliente está obligado a asegurar la(s) bicicleta(s) adecuadamente en todo momento cuando estén desatendidas, pasando el candado a través del marco y sujetando la(s) bicicleta(s) a algo fijo en el suelo, como un poste o una valla, si está permitido; de lo contrario, en un estacionamiento para bicicletas. Se recomienda encarecidamente mantener las bicicletas aseguradas en todo momento, especialmente durante los alquileres nocturnos. Las bicicletas de carrera y de montaña no se proporcionarán con candados, ya que el cliente NO debe dejar las bicicletas desatendidas bajo ninguna circunstancia.

LIMITACIÓN DE RESPONSABILIDAD

16. Marbella Rent a Bike ha obtenido la cobertura adecuada de seguro de responsabilidad civil de terceros para la actividad de alquiler de bicicletas. Marbella Rent a Bike no es responsable por lesiones o daños causados al/por el cliente durante el período de alquiler.

17. El cliente es responsable de contar con una cobertura de seguro personal adecuada para los riesgos que puedan ocurrir durante el período de alquiler. Marbella Rent a Bike no es responsable de reclamos por lesiones corporales o daños, accidentes o pérdida de pertenencias personales causados por el clima, enfermedades u otras causas más allá del control de Marbella Rent a Bike.

18. El cliente y su grupo deben respetar las normativas de tráfico españolas. Cualquier multa o sanción debido al uso incorrecto de la bicicleta será asumida completamente por el cliente.

19. La información proporcionada por el cliente está protegida por la Ley Orgánica 15/1999, de 13 de diciembre, sobre Protección de Datos Personales.

20. El lugar de jurisdicción exclusivo será Marbella, España. Este contrato se regirá por la ley española.
